‘A motion to commit theft’

CLINTON — Before a vote taken Thursday, DeWitt County State’s attorney Karle Koritz warned board members they were about to consider action that “could be characterized as a motion to commit theft.”

The motion being considered involved stopping all payments to FAB & Associates, the company that manages the Clinton Lake marina. The justification offered for the action was the board leadership’s vote to terminate the county’s contract with FAB.

Koritz, however, told the board it could not refuse to turn over money that did not belong to the county.

“It’s not the county’s money,” Koritz said. “It doesn’t come from levied funds; the county board has no control over it.”
